Biden’s veto of Repeal of Joint Employer Rule

Both houses of Congress wanted the National Labour Review Board’s (NLRB) Joint Employer rule to be voided. The rule states that any employer with “indirect control” can be the target of unionization. In the franchise world,  think McDonald’s corporate forcing thousands of franchises to hire only union staff. In supply chain, think of the shipper with a 3PL-run warehouse. Fortunately, a Federal judge blocked the rule in March, but the NLRB can appeal.

The U.S. Department of Labor (DOL) has introduced a new overtime rule that significantly affects supply chain operations, raising the weekly salary threshold to be considered exempt from overtime to $43,888.
